Canada Welcomes Digital Nomads Who Can Work From Anywhere in the World

In June 2023, Immigration, Refugees and Citizenship Canada (IRCC) introduced its first-ever Tech Talent Strategy aimed at attracting more tech talent from around the world to Canada. As part of this strategy, it includes a Digital Nomad Strategy, which actively seeks to bring digital nomad talent to Canada.
What is a Digital Nomad?
A digital nomad is someone who can work remotely from anywhere in the world as long as they have an internet connection and a computer. This way of working has been increasing with the diversification of work styles. In fact, at Visa JP Canada, we’ve noticed a sharp rise in the number of digital nomads, especially since the COVID-19 pandemic, where more people have embraced the idea of earning income from anywhere in the world.
Digital Nomads Working on Visitor Status
Under Canada’s current immigration system, digital nomads are allowed to stay in Canada for up to six months on visitor status and work remotely for an employer based outside of Canada, such as from Japan or another country. This is a shift from the previous understanding, where it was considered a gray area whether remote work for a foreign employer could be done while on visitor status. Now, IRCC has clearly stated that it is acceptable.
How to Enter Canada as a Digital Nomad
The government of Canada has not released specific procedures regarding applications for digital nomad work. However, digital nomads will only need visitor status to stay in Canada for up to six months, meaning they can simply enter as a visitor.
For Those With Nationalities from Countries Not Eligible for Visa Exemption
If a digital nomad or remote worker is from a country that is not eligible for visa exemption, they will need to apply for a Temporary Resident Visa (TRV). In the application, they will need to explain and prove that their remote work in Canada does not fall under the IRCC’s definition of “work.”
Digital nomads must demonstrate that their remote work does not take job opportunities away from Canadian citizens or permanent residents. Proof of financial stability during their stay in Canada will also be required.
Definition of “Work” by IRCC
“Work” in Canada refers to activities where wages or fees are paid, or activities that directly compete with the labor market opportunities of Canadian citizens or permanent residents.
For Those With Nationalities from Visa-Exempt Countries
If the applicant holds a nationality from a visa-exempt country (such as Japan), they can apply for an Electronic Travel Authorization (eTA).
In both cases, Canada Border Services Agency (CBSA) has the discretion to determine the length of stay upon arrival at the airport. If CBSA approves entry, the digital nomad can work remotely in Canada without a work permit.
What Does the Future Hold?
In its June 2023 announcement, IRCC mentioned that “In the coming months, we will collaborate with public and private partners to assess whether additional policies are necessary to attract digital nomads.”
IRCC also expects that some digital nomads who enter Canada to work remotely may decide to work for Canadian employers during their stay. If they receive a job offer from a Canadian company, they can apply for a work permit or permanent residence, allowing them to contribute their skills to Canadian employers and, in turn, help boost the Canadian economy.
