FAQ

Here are various frequently asked questions (FAQs) received by Visa JP Canada.

Visa JP Canada

Can I receive support even if I am not a Japanese citizen?

We are also able to assist in English. Feel free to reach out to us anytime!

Is it possible to consult with you even if I’m not in Vancouver?

Yes, absolutely. We provide extensive support to individuals residing in other cities across Canada, as well as those living in Japan or other countries. For clients outside Canada, we offer consultations via phone, Zoom, or email to ensure you receive the assistance you need, no matter where you are.

Do I need to make an appointment for consultations?

Our consultations are available by appointment only.

Is the fee payment required in full upfront?

For applications such as work permits (employer-specific work permits) or permanent residence, we adopt a payment-by-installment system, rather than a lump sum. The application process is divided into several stages: the initial payment is made at the time of contract, followed by subsequent payments after each stage, with the final payment due once the visa or permit is obtained. However, for permits, such as study permits, visitor records, and post-graduation work permits, which are typically completed in one step, we require full payment at the time of the request. Please note that payment terms may vary depending on the contract.

What measures do you take to store personal information securely?

Documents used for visa applications are stored in a secure, locked cabinet and are retained for six years in accordance with the regulations of the Immigration Consultants of Canada Regulatory Council (ICCRC). After this period, they are securely disposed of. This ensures the safety and privacy of our clients' documents.

Is it possible to consult on behalf of a friend?

Consultations regarding visas and permanent residence often require personal information, such as employment status, that only the individual can provide. To avoid any misunderstandings during the information exchange, which could lead to significant issues later on, we ask that inquiries be made directly by the individual concerned. This ensures that we can offer accurate and appropriate support. At Visa JP Canada, whether or not you decide to proceed with a contract, we welcome inquiries from anyone considering a Canadian visa or immigration application.

Visa Applications

Are there frequent updates or changes to the visa application requirements?

Due to economic factors such as Canada's employment situation and unemployment rate, the requirements may change irregularly.

I have a history of visa refusal in the United States. Will this affect my Canadian visa application?

A history of visa refusal in the United States does not affect your Canadian visa application.

I am unsure whether to apply on my own or to use a representative for my application. What are the benefits of using a Regulated Canadian Immigration Consultant as my representative?

Choosing a consultant to handle your application on your behalf offers a range of significant advantages. If the review process is delayed or additional documentation is required, the consultant can liaise directly with Immigration, Refugees and Citizenship Canada (IRCC) on your behalf, sparing you from unnecessary hassle. This not only streamlines the document preparation process but also eases the mental burden throughout the application journey. Moreover, if your employer is involved in supporting your application, using a consultant can greatly alleviate their workload as well, making the entire process more efficient for everyone involved.

I submitted the application on my own, but can I request support for the subsequent steps?

For those residing in Canada, it is recommended to contact the Immigration, Refugees and Citizenship Canada (IRCC) call centre. On the other hand, for those living outside of Canada, it is best to reach out to the relevant department via email.

My visa has been refused. What should I do?

Depending on the reason for the refusal, reapplication may be possible. It is recommended to first consult your situation via the inquiry form.

Permanent Residence

Can I still aim for permanent residence even if I’m not good at English?

The level of English proficiency required depends on the specific category of your application. In fact, there are certain categories where you may even be exempt from taking the English language test altogether.

I previously obtained Canadian permanent residence, but it has expired. Is it possible to regain it?

Depending on your situation, it may be possible to renew your permanent residence. I recommend reaching out to inquire about your specific circumstances. If your permanent resident status has completely expired, you can reapply for permanent residence, but you will need to go through the standard application process once again.

I haven’t graduated from high school, but is it still possible to aim for permanent residence?

Requirements can vary depending on your occupation, visa, and permanent residence application category. For more personalized guidance, we recommend reaching out to discuss your specific situation.

What is the definition of full-time work in terms of hours required for a permanent residence application?

Generally, full-time employment is defined as working over 40 hours a week. However, for visa and permanent residence applications, the criteria for full-time work may vary depending on the specific category. Additionally, the definition of full-time work can differ by province, so we recommend reaching out for the most up-to-date information.

Is it acceptable if there is a gap in the cohabitation period for a common-law relationship?

When applying as a common-law partner under the family class or similar categories, a continuous cohabitation period of at least 12 months is required. If the cohabitation is interrupted, you will need to prove another 12 months of living together, with the count starting from zero. If you can provide more details about your specific situation and the duration of any separation, we can offer tailored advice to guide you through the process.

What types of occupations can lead to permanent residence?

Generally speaking, individuals employed in high-skill occupations—referred to as 'skilled occupations'—are more likely to meet the eligibility criteria for permanent residence application categories. The Canadian government categorizes all professions with detailed codes, classifying each occupation by skill level.

Work Permits

I’m currently residing in Japan, but I’m interested in working in Canada. Is it possible to apply directly to job openings within Canada?

To work in Canada, you will need a work permit. Excluding those who already hold a work permit (employer-specific work permit), those who plan to obtain one, or those who already have permanent residence, job seekers must ensure that their potential employer is able to sponsor them for a work permit (employer-specific work permit). Additionally, the employer will need to apply for an LMIA (Labour Market Impact Assessment). For more details, please refer to the following link: LMIA-Based Work Permits

If your employer sponsors your work permit and you quit your job, what happens to your work permit?

A work permit sponsored by your employer allows you to work only for that specific employer. After resigning, you're not permitted to work for another employer, but you can legally remain in Canada until the work permit's expiration date.

Is it possible to apply for a work permit even with minimum wage?

When applying for a work permit (employer-specific work permit), you must be employed at a wage that is at or above the average for that occupation and region. Since average wages can fluctuate, we recommend checking the most current information before proceeding. For further details, please refer to the following link: LMIA-Based Work Permits

Is it possible to obtain a work permit with part-time work or irregular shifts?

To apply for a work permit (employer-specific work permit), full-time, year-round employment is generally required, though there are some exceptions, such as for agricultural workers. If you're currently employed part-time and wish to obtain a work permit, we recommend first confirming with your employer whether full-time employment will be available in the future. For more details, please refer to the following link: LMIA-Based Work Permits

How can I obtain a work permit?

To obtain a work permit (employer-specific work permit), you typically need a job offer from a sponsoring employer, along with approval of that job offer from Employment and Social Development of Canada (ESDC). For more details, please refer to the following link: LMIA-Based Work Permits

What are the basic requirements to work in Canada?

To work in Canada, obtaining a work permit is required. Once you have this permit, you will be issued a Social Insurance Number (SIN), which allows you to legally receive a salary and handle income tax matters. However, there is an exception for full-time students who applied for a study permit after June 1, 2014, and are enrolled in a designated institution offering post-secondary education (or vocational training programs at the secondary level in Quebec). These students may work off-campus: up to 24 hours per week during school sessions and full-time during scheduled breaks.

For Corporations

I want to start a business in Canada. What steps do I need to take?

Since the best approach and options vary depending on your business plan and specific circumstances, it is highly recommended to work with a qualified Regulated Canadian Immigration Consultant to develop your plan and receive personalized guidance.

Do you handle work permits for employees being transferred to Canadian companies, such as intra-company transferee work permits, or for researchers?

Our company handles all types of work permits in Canada, including intra-company transferee work permits and postdoctoral work permits for researchers.

When requesting services, when should the payment be made?

After the free consultation, if you decide to formally request our services, we will proceed with a contract. The payment for processing fees is typically required in full at that time. However, for corporate clients, we are flexible regarding the timing and method of payment to suit your needs. If you have any specific preferences, please feel free to contact our legal assistants.

Can you communicate directly with foreign employees in their native language?

We are happy to communicate directly with your employees to meet your needs. Currently, we can provide support in both English and Japanese. We offer explanations of application documents and the visa process in the required language as needed.

What is required to become a sponsor for an employee’s work permit?

To be a sponsor, the employer must provide a job offer that meets the required conditions and ensure the employment aligns with those conditions. The specific requirements vary depending on the occupation being offered.

Others

Is the insurance system in Canada similar to that in Japan?

The insurance system in Canada is quite different from Japan, with a particularly robust healthcare system. Unlike in the U.S., there is no involvement from private health insurance companies. Health insurance is available to Canadian citizens and permanent residents, although some provinces may allow temporary residents to join. To apply, you will need to provide documents such as a birth certificate, permanent residence card, or passport. Permanent residents are immediately eligible, but in provinces like British Columbia, Ontario, and New Brunswick, there is a three-month waiting period. Health cards are issued to those covered by provincial health insurance, and the registration process is handled through the provincial health ministry. Canadian citizens and permanent residents can only use their health card in the province where they are registered, so if you move to another province, you will need to obtain a new card. While traveling to other provinces for tourism, you can use your health card in case of an emergency. This insurance covers most medical treatments free of charge, with the exception of dental care.
