Employer Job Offer: International Student Stream

This stream provides international students who have received a job offer in a skilled occupation with the opportunity to apply for permanent residence and work in Ontario.

Eligibility requirements for the Employer Job Offer: International Student Stream (Applicant Side)

Educational Background

  • You must prove you have obtained one of the following eligible credentials:
    • an undergraduate degree or diploma that takes at least two years if pursued on a full-time basis from an eligible Canadian institution
    • a graduate degree or diploma that takes at least one year if pursued on a full-time basis from an eligible Canadian institution
    • a college graduate certificate that takes at least one year to complete if pursued on a full-time basis from an eligible Ontario institution
    • a university graduate certificate that takes at least one year to complete if pursued on a full-time basis from an eligible Ontario institution
  • You must prove that more than half of the requirements necessary to obtain your credential were obtained while living and studying in Canada.
  • Your application must be submitted within two years of graduation.

Job Offer

  • Full-time means the job must be a minimum of 1,560 hours a year and a minimum of 30 hours of paid work per week.
  • The pay of the job offered must meet or be higher than the low wage level, for that occupation, in the specific region of Ontario where you will be working.
  • The position offered must be urgently necessary to your employer’s business.
  • If your job offer is for an occupation that requires a mandatory licence or other authorization in Ontario, you must hold a valid licence or authorization from the appropriate regulatory body in Ontario when you apply.
  • The job offered must be in a skilled occupation at TEER Category 0, 1, 2 or 3 of the National Occupation Classification (NOC).

Applicable Skill Levels (TEER)

The skill levels are specified within the National Occupational Classification (NOC) as follows:

Skill Level 0 Managers, company executives, and supervisory roles.
Skill Level 1 Professional occupations that usually require a university or graduate degree.
Skill Level 2 Technical occupations and middle management that typically require a college diploma or more than 2 years of apprenticeship training.
Skill Level 3 Intermediate technical occupations that generally require a college diploma, less than 2 years of apprenticeship training, or more than 6 months of on-the-job training.

Language proficiency

The applicant must have achieved a CLB 4 or higher on an approved English or French language test, taken within two years of their application.

Work based in Ontario

The applicant and their family members must not hold more than 10% of the employer’s shares.

Legal status in Canada

If you are applying from within Canada, you must have legal status (a visitor record, study permit, or work permit) at the time you apply and should maintain that status until the time of nomination. However, this requirement does not apply if the application is being made from outside Canada.

Intention to live in Ontario

You must intend to live in Ontario after you have been granted permanent residence. In this category, receiving a nomination from the Ontario provincial government to the Immigration, Refugees and Citizenship Canada (IRCC) significantly increases the chances of obtaining permanent residence, making it almost certain once nominated by the province.

Eligibility requirements for Job Offer: International Student Stream (Employer side)

  • Your employer must have been in active business for at least three years prior to submitting your application.
  • Your employer must have been in active business for at least three years prior to submitting your application.
  • Your employer must have no outstanding orders made against them under the Ontario Employment Standards Act, 2000 or the Occupational Health and Safety Act.
  • You employer must have a minimum of $1,000,000 in total gross annual revenue if you will work or report to work at a location in the Greater Toronto Area (City of Toronto, Durham, Halton, York and Peel regions). If you will work at a location in the Greater Toronto Area (GTA), your employer must have at least 5 full-time employees who are Canadian citizens or permanent residents.
  • You employer must have a minimum of $500,000 in total gross annual revenue if you will work or report to work at a location outside the Greater Toronto Area. If you will work at a location outside the Greater Toronto Area, your employer must have at least 3 full-time employees who are Canadian citizens or permanent residents.
  • For applicants residing outside Canada or outside Ontario, your employer must have previously conducted recruitment efforts for Canadian citizens or permanent residents before offering the position.
  • Your employer must submit a Pre-screen Application and receive approval before proceeding with the application. Once approved, the full application must be submitted within 60 days.

Application process for the Employer Job Offer: International Student Stream

01Once the minimum requirements are met, register on the OINP e-Filing Portal.

Applicants who meet the eligibility requirements for the Employer Job Offer: International Student Stream under OINP must register their profile on the OINP e-Filing Portal. Once the profile is registered, a score out of 200 points will be calculated based on the information provided. The applicant will then be placed in the pool of candidates for selection.

02Receive an Invitation to Apply (ITA)

An Invitation to Apply (ITA) grants you the right to submit your application for the Ontario Immigration Nominee Program (OINP). Only after receiving an ITA, you can proceed to submit your application to the Ontario provincial government. The OINP conducts regular draws, known as “drawings,” where candidates in the pool are selected based on their scores, with higher-ranking candidates receiving ITAs first. If you do not receive an ITA, you will remain in the selection pool for up to one year.

03Apply online for the Ontario Immigration Nominee Program (OINP)

Once an Expression of Interest (EOI) is received, both the applicant and the employer must complete and submit the online application to the OINP processing office within 30 days. This step is crucial to move forward in the nomination process.

04Receiving a Nomination Certificate

Once the review at the OINP processing office is complete, the applicant will receive the results. Passing the review is referred to as being nominated.

05Apply for permanent residence to IRCC

After being nominated, the applicant must submit their permanent residence application online to IRCC within six months.

06Review by IRCC

After the review is completed by IRCC, the applicant will receive a letter called the Confirmation of Permanent Resident (CoPR).

07Landing

Applicants from outside Canada will enter Canada with their Confirmation of Permanent Resident (CoPR). Applicants from within Canada can complete the landing process online.

08Receive your Permanent Resident (PR) card

Your PR card will be delivered to the designated address within Canada within a few months.
