Canada Strengthens Regulation of Immigration Consultants: How to Choose the Right Visa Agent and Avoid Scams

Applying for a Canadian visa or pursuing permanent residence (PR) is one of the most important decisions many people make. Because immigration laws and programs can be complex, many applicants choose to use a visa agent or seek professional application assistance.

In May 2026, the Government of Canada announced new measures to strengthen the regulation of Immigration and Citizenship Consultants. The changes are designed to better protect applicants from fraud and unethical practices by unauthorized agencies, while improving transparency and accountability within the immigration consulting profession.

Canada’s Regulated Immigration Consultant (Visa Agency) System

In Canada, individuals who provide immigration advice or act as a visa proxy for a fee must generally be authorized representatives.

One of the primary authorized representatives is a Regulated Canadian Immigration Consultant (RCIC), who is licensed by the College of Immigration and Citizenship Consultants (CICC).

To become an RCIC, consultants must meet education and licensing requirements, pass professional examinations, complete ongoing professional development, and comply with a strict Code of Professional Conduct. They are also subject to oversight by the CICC.

Despite these safeguards, unauthorized visa agents and unethical practices continue to be a concern, particularly through online advertisements and social media. The Government’s latest regulatory changes are intended to strengthen public confidence in the profession and enhance consumer protection.

What Will Change?

The new regulations introduce several important improvements.

1. Stronger Enforcement Against Misconduct

The CICC will have enhanced authority to investigate complaints and take disciplinary action against consultants who violate professional standards. Examples of misconduct may include:

  • Providing misleading or false information
  • Failing to act in the client’s best interests
  • Violating professional or ethical obligations
  • Mishandling client funds

Strengthening these enforcement powers will help ensure greater accountability across the profession.

2. Greater Transparency

Beginning in 2027, additional information will be available through the CICC’s public register, making it easier for prospective clients to verify whether an immigration consultant is properly licensed and in good standing.

This initiative is intended to help applicants distinguish licensed professionals from unauthorized representatives before seeking immigration assistance.

3. Enhanced Consumer Protection

The Government is also establishing a stronger framework for the Compensation Fund, which may provide financial compensation to clients who suffer losses as a result of misconduct by licensed consultants, subject to applicable rules and eligibility requirements.

This additional safeguard is designed to further protect consumers and reinforce trust in Canada’s regulated immigration consulting system.

What Applicants Should Consider When Choosing an Immigration Agency

The Government’s announcement also serves as a reminder that choosing the right immigration representative is an important part of the immigration journey.

Before hiring an immigration consultant or visa agent, applicants should consider the following:

  • Verify Professional Credentials: Not everyone who advertises Canada PR application services is authorized to provide them. Always verify that your representative is licensed with the CICC before engaging their services.

  • Be Cautious of Guaranteed Results: No consultant, regardless of experience, can guarantee the approval of a visa or PR application. All immigration decisions are made solely by Immigration, Refugees and Citizenship Canada (IRCC). Promises of guaranteed approval should be treated with caution.
  • Look for Personalized Advice: Every immigration case is unique. Factors such as education, work experience, language ability, family circumstances, and long-term goals all influence the immigration options available. A qualified professional should explain both the opportunities and the potential risks associated with each pathway, rather than offering one-size-fits-all solutions.

Using the services of individuals or agencies who provide immigration assistance or advice for a fee without proper licensing poses a significant risk to applicants (e.g., visa refusals due to incorrect applications, or being banned from entering Canada due to misrepresentation).
